Today's ZGram: First a press release, followed by some comments. History is being made in Canada once more in the Zundel case, and things are heating up.

The Canadian Jewish Congress is bringing a motion to quash, suspend or delay all Judicial Review applications Ernst Zündel's attorneys have instituted in jurisdictional and statutory areas against the arbitrary and unfair Canadian Human Rights Tribunal's actions and rulings. Attorney Doug Christie will represent Ernst Zündel.

Also that same day, 15 January 1999, three people accused of having sent mousetraps with razor blades, threatening letters, and "things", some of which exploded, to a number of people in Canada in 1995, including Ernst Zündel, are having a pre-trial hearing in the Provincial Court of British Columbia, Court Room 306, 222 Main Street, Vancouver, B.C. Canada.

 

The public and media can attend, even though, incredibly in a case of this nature, a "publication ban" on what goes on inside the court room is in effect. This story continues to smolder. Responsible media are alerted to this case and asked to attend. Somebody has to keep an eye on what is going on and how this case is being handled.

Zundelsite Comments:

 

The Canadian Jewish Congress motion to "quash, suspend or delay all Judicial Review applications" will find itself pinned in the court room tomorrow against Judge McGillis' ruling in the Bell versus Ontario Human Rights Commission case, where the presiding judge ruled, in part, in "The Consequences of a Finding of Bias:

 

"Everyone appearing before administrative boards is entitled to be treated fairly. It is an independent and unqualified right. As I have stated, it is impossible to have a fair hearing or to have procedural fairness if a reasonable apprehension of bias has been established. If there has been denial of a right to a fair hearing, it cannot be cured by the tribunal's subsequent decision. A decision of a tribunal which denied the parties a fair hearing cannot be simply voidable and rendered valid as a result of the subsequent decision of the tribunal. Procedural fairness is an essential aspect of any hearing before a tribunal. The damage created by apprehension of bias cannot be remedied. The hearing, and any subsequent order resulting from it, is void."

 

The language could not be more clear. Yet when this sweeping ruling was first announced a year ago, Mr. Duval, the attorney for the Human Rights Commission in some instances at the Zundelsite court hearings, told a judge in Ottawa: "It is business as usual."

 

Raw chutzpah in the face of law!

 

This free speech case gets ever more complicated and tangled, but Columnist Doug Collins, also victimized by a Canadian Human Rights Commission, put it succinctly:

 

"What is a kangaroo court? It's a tribunal where truth is no defense, where opinion is on trial, where fines can be unlimited, where there is no trial by jury, where the judge, called an "adjudicator", is judge, jury and prosecutor, where there is no right of appeal from within the framework of the Act, where normal rules of evidence don't exist, and where impressions count for more than facts. This is no longer a free country..."

 

So we shall see tomorrow if there will be a judge "sensitive" to the interests of the well-connected, or if Ernst Zundel gets a judge who will rule on the side of an ordinary citizen's right instead of the might of the powerful and ruling oligarchy.

The second case before a court plays on the other side of Canada and pertains to the three punks who did their mysterious mischief with the razor blade business and "things" - which is what the government calls the parcels, some of which exploded! - and other murky matters and violent causes.

 

I have on the Zundelsite a most interesting document titled "Zundel-Haus Bombing Suspects Identified" at http://www.webcom.com/ezundel/english/chrc/search1.html/ where I am keeping a block so Zundelsite visitors, for the time being, are prevented from accessing it. It has to do with an even more mysterious ban on ***any news*** pertaining to the fact that ***any mention of an assassination attempt on Ernst Zundel's life has been dropped from the charges*** filed against the three accused by the British Columbia Attorney General's Office - headed by the same man who eagerly lobbies for greater, expanded "Hate Laws"!

 

Why?

 

Your guess is as good as my guess. We know that some media folks have the scent. I have a feeling there will be lots of revelations if the case is vigorously prosecuted and not just a perfunctory exercise of obfuscation and white-wash.

 

I will remove the block the moment the publication ban on this story is lifted.
