I'll now restrain myself and call this mildly "A Day At Court In Ottawa" because below you are seeing a prelude, for today was an important Day for Freedom of Speech aficionados in Canada.
The story around the Zundelsite gets ever more grotesque, and generations will still be shaking heads about what's happening in Canada less than two years before this century of misery inflicted in no small part by Kommissars and such has run its sorry course.
To recap briefly and make it "simple at a glance" - an almost important endeavor:
A judge has called the CHR Tribunals bluff, and since several Tribunals were already either sitting or in the process of getting positioned to do their political havoc, a small cadre of both victims and victimizers met today in court. One such victim is Via Rail. Another target is Ernst Zundel. There are others, but this was an instance of "short notice."
Ernst Zundel and Lawyer Barbara Kulaszka appeared in Ottawa Federal Court to try to intervene on the side of Nova Scotia Via Rail. Via Rail lawyers tried to have the Tribunal declared quashed or void, based on the famous and courageous McGillis decision which called Human Rights Tribunals "biased to reasonable observers" - an example of understated speech.
The Human Rights Commission lawyers were there in full force represented by Senior Counsel Rene Duval who was hoping the judge would stop Via Rail's motion to quash, and in turn impose an injunction against further attempts to invoke the McGillis decision so that this parasitic, agenda-driven outfit could carry on its vendettas against the politically and socially incorrect.
The Nova Scotia Human Rights Tribunal was represented by two lawyers - AND FOUND ITSELF UNDERCUT by the Federal Human Rights Commission lawyers! A rather novel scene, to say the least - it looked like the proverbial "biting the hand that feeds you. . . "
Via Rail wanted the proceedings against themselves quashed.
Zundel's lawyer supported that motion by Via Rail to quash the proceedings, or at least stay them and its own, until a higher, real court could look at the entire confused mess.
Judge Roulo (sp?) who will become the Assistant Chief Justice of the Federal Court of Canada on Monday entered the courtroom at 10 a.m. sharp. He listened to CHRC Senior Counsel Rene Duval's rather flowery presentation of his case. It took the Judge less than 15 minutes to shoot the Canadian Human Rights Commission's attempt at gagging everybody pre-emptorily down - in no uncertain terms!
He told all assembled that he was NOT going to get himself mired in piecemeal decisions in such an important case where many issues, even constitutional issues, would be involved. He told Mr. Duval and the others that the Zundel case would be dealt with in Toronto from April 27 to 29, and things would be decided there. The judge in these proceedings would look at crucial and important aspects - such as: constitutional questions, the McGillis decision regarding apprehension of bias, intervenor status by all kinds of organizations who suddenly discover that they want to interject themselves into this landmark case etc. etc.
The gist of the Judge's brief comments was that the Zundel Case was extremely important!
So listen carefully:
Once more it is the Zundel case against which the censors are batting their heads. Always Zundel!
Perverse as it may seem to outsiders: Here is a man who has been denied citizenship for 40 years in Canada who once again to a great extent holds in his hands, as he did in the two Great Holocaust Trials that resulted in the 1992 Supreme Court decision - if Canadians will be free of the persecutions by a Human Rights oligarchy run amok!
Canadians will once again find out if they have to endure the heavy-handed curtailments of their human rights by these latter-day Torquemadas of threadbare, recycled old party hacks, re-treaded latter-day Marxists, failed and discredited liberals and socialists of all stripes!
Make no mistake about it: The Zundel Case will be the Litmus Test how free Canadians will be or will feel in the months and years to come. An editorial on April 15 in Canada's Ottawa Citizen has said as much - of which more at a later time, believe me!
Mr. Justice Roulo (sp?) who will have the power to assign judges sitting in Federal Court cases, stated today that "an efficient judge" will handle the case, and that of the many intervenors, maybe as few as two will be allowed.
Ernst was heard saying, one bushy Zundel eyebrow lifted: "Could it be our fate again to get Judge Rothstein. . .?"
The Zundel Legal Team stands poised.
