Good Morning from the Zundelsite:

At the end of October I prepared a series of five ZGrams based on excerpts from the ongoing Canadian Human Rights Tribunal hearings initiated against the Zundelsite. As you will remember, these hearing resume December 11 and are expected to run at least until June of next year.

A few minutes ago, I posted these five ZGrams with a prominent "fight-censorship" internet group, along with the explanatory ZGram (below) in a formal request to assist us. Whether or not they will do so remains to be seen, but I certainly hope that some of them will. (For the next five days, you will be treated to these excerpts on the principle that where I go, my crumb trail goes...)

Here is what I am telling them:

Jamie McCarthy, formerly of Nizkor, the "politically correct" Holocaust promotion website, has condescendingly taken it upon himself to inform the f-c list participants that, in the newest censorship battle around the Zundelsite, Ernst Zundel is ". . . weaseling out on a technicality". The following might help to set the record straight.

What is happening in Canada is a precedent-setting censorship attempt by the state. It is not a trivial matter to be dismissed lightly by genuine freedom-of-speech advocates. I have followed some of your discussions on "censorial leftists" etc., and I particularly recall one of your participants, Peter Herngaard, speaking in another post of the "Human Rights disease" that has infected Europe already.

That same disease has already infected the Canadian body politic and is well on the way to becoming entrenched in the United States as well, promoted by the same forces. Alarm bells should be going off for those who deal in words and thoughts! It is ever more clearly recognized by people genuinely committed to keeping the Internet free of censorship that these so-called "Human Rights Commissions", parasitically feeding on public monies, are state-sanctioned instruments of social engineering, leading to the destruction of our freedoms, used on behalf of special interest groups who like to censor the opinions of their critics.

This is, therefore, a formal and urgent appeal to "fight censorship" readers to lend us their expertise and to assist us in our legal struggle for unimpeded global information outreach via the Zundelsite. You claim you have a cyber-culture that is very dear to you. The fate of mankind and its many cultures must be based on factual information grounded in truth, and what you have been told by people like Ken McVay, Jamie McCarthy or David Jones of the EFF about the Zundelsite and about the nature of our legal struggle is not based on factual truth.

The gist of our legal defense on behalf of the Zundelsite is summarized in five ZGrams I prepared a few weeks ago but never shipped or posted because I learned that there were possible copyright problems in that some court reporters claim that they own the copyrights to proceedings they record. (Similarly, some judges may claim copyrights on their judgements). Only two days ago did Ernst Zundel receive the green light from the Canadian Human Rights Commission, who owns the copyright, to post excerpts for limited use. I thus prepared and now post these excerpts in the form of five ZGrams for your inspection.

With my apologies for not following your usual format, I would like to offer these five ZGrams AS SUMMARIES OF THE OPENING LEGAL ARGUMENTS made by main Zundel defense attorney, Doug Christie, before the Canadian Human Rights Tribunal in the two-day hearing on May 26-27 of this year. You can see for yourself that the arguments advanced are along constitutional and jurisdictional lines because the Canadian Human Rights Commission and its Tribunal insists the Internet is "like a telephone" and, hence, subject to the jurisdiction under telephone hate messages on info-telephones, which are against the law in Canada.

As the webmaster, creator, designer and maintainer of the Zundelsite, I have been a lurker on your list - excepting a brief hiatus when the content of your conference discussion became too technical for me - ever since the cyberwar of January/February 1996 that gave rise to the Zundel-Mirrors. On the few occasions when I posted, I was treated to such verbal abuse and out-and-out filth on the part of some of the participants of this list that I withdrew in wounded pride. Therefore, you do not know me.

I am a human being. Ernst Zundel is a human being. We don't make bombs. We don't talk smut. There is no "Nazi" party and no membership. We have a history as Germans to which we claim the right of access, and which we strive to disseminate to other interested lovers of truth in history.

The Holocaust Lobby accuses Germany and Germans of the heinous crime of genocide. With all we have to give, historical Revisionists challenge that accusation with websites such as the Zundelsite and ask for a fair hearing.

To quote a Revisionist writer,

". . . to accept without a doubt, to accuse without evidence, to intimidate without proof, to lie without punishment. . . was unthinkable in the West . . . . In the case of the Holocaust, the bodies are missing, their numbers unproved, the method of killing disproved, the places not there, and the witnesses incredible.

"Nevertheless, in spite of revisionist research by the top scientists and scholars of the West who have risked all that is possible in life to risk for the sake of ascertaining the truth, the speaking and remembering and fictionalizing about the Holocaust proceeds untouched by facts.

"Why? Because it is a Jewish religious dogma or doctrine, and to question it makes one a heretic and subject to persecution and prosecution." (Ben Weintraub in "The Holocaust Dogma.")

We are the lepers of today. We are defending ourselves against SCIENTIFICALLY, FORENSICALLY AND HISTORICALLY UNPROVEN ACCUSATIONS, and we are fighting with limited weapons. We are technical illiterates. I write in my sixth language; Ernst in his fourth. Neither Ernst nor I have had the luxury of a formal education in our youths - what we have learned, we learned on our feet, and at great costs to soul and spirit. We are much more than the "Nazis" so many people, who know nothing of our struggle, just love to hate and vilify.

We have a legitimate cause.

You do not have to like us. You can dislike us all you want. We only ask that you respect the legitimacy of our search for historical truth, wherever it may lead - and that you lend us your expertise in legal and technical matters, because we do not have those resources.

Our opposition is largely but not exclusively Jewish. Our supporters are largely but not exclusively German or of German descent. We cannot help that; it is built into our struggle. You say your list is not concerned with all the ins and outs pertaining to the "Holocaust" - and you are right. But it is the *basis* on which you treat us like lepers and deny us your expertise and talents - and for that reason it is relevant.

Ours is a very simple maxim: Science cannot be suspended, not even for the "Nazis." We stand and fall on our evidence. If we are right, in the long run all human beings on this planet with access on to the Internet will benefit because the freedom to access information, unimpeded! will be strengthened. If we are wrong, then we will self-destruct and be the laughing stock.

What's there to fear from websites like the Zundelsite?

There is a legal reality here that you, as professed freedom fighters, cannot afford to ignore - and it is this:

The Canadian Human Rights Commission has the power to gag Ernst Zundel in Canada with a "cease and desist" order - and mark my word: they will! More yet, they will fine him and throw him in jail or, with the help of a compliant government likewise beholden to special interest groups, deport him to Germany where he will rot in jail.

They will do that as soon as they can, and as long as they believe that they can get away with it - because Canada has "hate laws" he is supposed to have transgressed against. (And never mind that the documents for which he is faulted are perfectly legal in print! And never mind that some if not most of them are copyrighted in my name!)

The CHRC and similar human rights organizations have not been elected; they are appointed and politically beholden tools. They are accountable to no one. They function arbitrarily and outside of the normal constraints of Canadian law. They have the power to impose unlimited financial fines. If they succeed in their "cease and desist" attempt, Ernst Zundel will become the first man gagged and prevented from having his voice heard on the Net. As we have been given to understand, not even his name may be mentioned on the Net - as in "The Zundelsite" - if Ernst's opponents succeed.

If they can gag him, these "human rights" commisions can gag others. These Kommissars can keep not only me but you from having access to information you are entitled to receive.

Now you will say: "What do we care? One Nazi more, one Nazi less - the world will still turn on its axis."

In this specific instance, it means that I, as an American citizen, knowing that Ernst Zundel will be punished like a common criminal for things that I write and post - my work AND other people's work - am under enormous emotional blackmail to scrap the Zundelsite. I happen to respect and value the man called Ernst Zundel. You may or may not; that is up to you. I see the stranglehold, however, around Ernst Zundel's neck, and I am saying to myself: "Is the Zundelsite really worth the destruction of this man? Can I live with myself if I dig in my heels if it costs him his freedom - and maybe his life?"

Ernst Zundel happens to be THE Renaissance man of the Revisionist movement. There is no one on earth who comprehensively understands this ideological struggle as he does - and who is focused enough to translate it so that the uninformed can grasp what is at stake. I need him as my resource. I have strong literary skills, but I don't have the comprehensive historical underpinning to carry on the Zundelsite without his knowledgable input.

If they gag Ernst Zundel, that will be an indirect gag on me. I am, however, a United States citizen as well as a world citizen, and I have the RIGHT, according to the UN Declaration of Human Rights to which both Canada and the United States are signatories, to ". . . inform myself across boundaries, and regardless of frontiers."

The Canadian so-called "Human Rights Commission" is denying me that right. Under your very noses, the Canadian Human Rights Commission is trampling over a United States citizen with Gulag boots. The CHRC has never seen fit to inform me of any legal moves against the Zundelsite. The CHRC has refused to hear my testimony, although I flew to Toronto at my own expense and made myself available. The CHRC is a Soviet-style instrument that is being used in a test case that ought to be of great concern to you, regardless of whether or not you approve of what we are doing and saying.

I will now post the five ZGrams, which are a condensation of our side of the legal argument, for your inspection and reflection. I ask you to act on what you claim to be - true freedom fighters for unfettered access to information on the Net, INCLUDING HOLOCAUST DEBUNKING INFORMATION.
