I hope to comment on this trial in a few days, but for now we are involved in the resumption of the CHRT-Zundelsite hearings, and therefore first things first:

 

The Canadian Association for Free Expression sent out the following yesterday:

 

Dear Free Speech Supporter:

 

Next week, the Canadian Association for Free Expression (CAFE) begins two weeks of evidence before the Canadian Human Rights Tribunal, adjudicating a shameless Canadian Human Rights Commission power grab. The CHRC seeks to extend Section 13.1, which forbids "communicating telephonically" messages "likely to expose to hatred or contempt" the usual parade of privileged groups (race, religion, etc.), to the Internet. The Internet, of course, is not telephonic communication. The Zundelsite, the object of this inquiry, is not located in Canada. It is owned, not by Ernst Zundel, but by Ingrid Rimland, an American citizen.

 

CAFE will be leading evidence that will, if permitted to be heard, be shocking and will expose as a massive scam much of the "evidence" used to justify "hate" legislation more than three decades ago.

 

We, of course, entirely support, adopt and endorse this motion.

_________ The lawyers for Ernst Zündel have filed a historically significant notice of motion regarding the constitutionality of section 13(1) of the Canadian Human Rights Act with the Canadian Human Rights Tribunal.

 

The Zündel attorneys notified all the Attorneys General of Canada with a Notice of Constitutional Questions.

 

All parties to the Zundelsite Tribunal hearings were also notified of Mr. Zundel's intentions.

 

This is the first serious, fundamental challenge to the Orwellian legislation underlying Canada's repressive Hate Legislation and the spin-off consequences of its of quasi-judicial instruments of persecution and censorship.

 

This move comes at the closing stages of an almost five-year marathon legal battle Ernst Zundel and his lawyers have waged for freedom in the Internet!

 

The text of the motion was shipped around the world in a ZGram dated November 16, 2000. It will be archived shortly on the Zundelsite for history.

 

In a parallel, utterly bizarre development, the Jewish lawyers and those arraigned against Ernst Zundel, all of whom fancy themselves as great litigators, have turned this legal hot potato of the constitutional validity of section 13 and 13.1, as it relates to the Internet, over to a Mr. Earle, a quiet, self-effacing pencil pusher cum lawyer for the Toronto Mayor's Committee on Racism!

 

The legal front has shifted tellingly.
