Since the New York Times of August 2, 1998 article has stirred such global interest and caused other influential news sources to contact us, I go into some detail about the Zundel Struggle in this ZGRam - details that will be familiar to regular Zundelsite readers.
I beg your indulgence, but this New York Times article is worthy of amplification to help reporters new to the topic to understand what is involved. These curious reporters might decide to be helpful to us. Believe me there are a growing number of those - conscientious media folks who are now alerted to the suppression of news and who weave the information about our struggle even into stories appearing by them in the traditionally hostile mainstream media!
Here are my comments on Part III of the August 1998 New York Times write-up that starts with the obligatory expression of contempt for Mr. Zundel's struggle:
NYT: (Zundel) sees himself as a martyr, hounded by governments that have unfairly portrayed Germany's history. The Zundelsite, set up in 1995, prominently features his assertion that reports of the Holocaust are a hoax.
Ingrid: Most people would consider themselves "martyred" if they had been dragged by their government before the courts for decades, handcuffed, body-searched, tried, jailed, and convicted for peacefully expressing perfectly constitutionally protected views. Would sane people not consider themselves "martyred" if their faces were pictured in thousands of posters in the cross hairs of a rifle, along with a picture of themselves, their house, their address, replete with a crude map and arrows pointing to that address? This poster was plastered all over downtown Toronto by the thousands - a blatant incitement to murder!
As a result of these posters, the Zundel-Haus was torched, causing property damage of over $400,000 and the loss of a lifetime's work and research, along with a library of 5,000 irreplaceable books. A person suffering that kind of loss would surely have the right to call himself a "martyr".
Who wouldn't see himself as "martyred" had he been sent two deadly bombs, one of which exploded? Neither of these crimes have ever been properly investigated by the Toronto Police, much less solved.
Likewise, the Toronto police have never arrested anyone on this postering incitement to arson and assassination - to this day! The criminals in the arson and mail bomb cases have yet to be punished by Canadian authorities, although a few connected to the second mail bomb were caught two years after the event - and then promptly set free the next day!
Even more strange and sinister, a ban on publication of the proceedings of this arrest has been ordered by the courts - not a few people wonder why! All references to "bombs" have been dropped - along with all the names of the victim recipients of these bombs, including Ernst Zundel! (These references had been in the 63-page search warrants executed by the RCMP, which mentioned the "attempted murder of Ernst Zundel")
Nice cops? Nice court? Nice law enforcement?
NYT: But Kenneth McVay, founder and director of the Nizkor Project, an extensive Holocaust resource Web site, sees the issue differently. "Zundel is a man who peddles lies and hatred for profit," he said.
Ingrid: Kenneth McVay has the endorsement and financial support of B'nai Brith fund-raisers for fantastic and bizarre stories posted such as "Nazis tickling homosexuals to death at Auschwitz" (!) and thousands of posts of the most absurd, defamatory, outrageous claims against Germans - all this, of course, in the guise of "fighting Nazis"!
Ken McVay does this with tax deductible contributions of at least one of B'nai Brith's fronts and with the moral and political blessing of Canada's Human Rights Thought Cops - and, of course, with the blessing of all the "hate crime" units across the country! In fact, Nizkor people were invited to lecture at an "Internet hate" symposium - and were apparently shown sensitive documents by the "hate cops" about investigations in progress. I wrote and asked to be permitted to participate to bring some balance to that symposium. Nobody cared for my side of the story! I was not invited.
Furthermore, the Nizkor hate website against Germans is located and operated in Canada! Nizkor's and McVay's postings and materials hurts the feelings of Germans in Canada.! Yet no CHRC investigates and hounds Kenneth McVay. Surely someone in Canada could logically one day claim jurisdiction over the Nizkor site - and then watch the doodoo hit the fan!
NYT: Among the thorny issues raised by this case is how to determine the origin of an Internet site. If the Zundelsite is based in California but Zundel is in Toronto, to what country does the site "belong" and who is responsible for its contents?
Ingrid: Legally - and that is supposedly the crucial point at issue here - just how, precisely, does the CHRC even ***presume*** to have jurisdiction over the Zundelsite in California? A website I set up? A website that I chose to call the Zundelsite - as per my affidavit? Which I maintain on an almost 24-hour, around-the-clock basis - and have done so for three years? Where I code my material on my computer, using my software, in my office in America? A website for which I pay - with the help of hundreds of people from all kinds of countries who send their freewill donations to me? (Donations to the Zundelsite are ***not*** tax deductible!)
There are political considerations here. There is a transparent political agenda at work by the CHRC - which is, as Mr. Pentney, chief legal counsel for CHRC, brazenly admitted to the New York Times reporter, to "control" Mr. Zundel, as if it is his prerogative or business - or anybody's business who claims to live in a "free" country and works for an outfit supposedly "protecting" human rights - to "control" another human being's thoughts, opinions and expressions of controversial and inconvenient issues!
The question underlying all this is, quite simply: "Did Six Million Really Die?" If it turns out they didn't - at least not as described by being gassed en masse - we are talking systematic negative ethnic stereotyping of Germans and massive financial reparations fraud - ***a fraud prevented from being exposed by people like Pentney and his outfit***. We are talking serious extortion on a global scale! And we are talking about many people - cops, prosecutors, judges, politicians as well as members of the media - being possible accessories to a criminal activity, namely reparations extortion, carried out world-wide under the ever-convenient umbrella of an artificially created, hyped and pushed-down-our-throats deception called the "Holocaust".
Not many of us directly involved in this case have illusions about the CHRT outcome. After the disgusting Torquemadas are through with their Kangaroo Kourt in Toronto. Mr. Zundel will be found guilty by this Soviet style Tribunal and fined up to $50,000 plus costs for all the lawyers of the opposition. And that is only the beginning - for worse is yet to come. That is precisely what will happen - unless we secure and hopefully win that all-crucial judicial review, which has been sabotaged by all kinds of questionable delaying tactics by the Human Rights Commission lawyers.
We think that there is still a chance, for the Canadian public is angry. Some of the once-tranquil Canadian media mavens have powerfully spoken up. The German organizations in Canada have now been roused. They dislike what they see - and they dislike what is being done in their name by these so-called "Human Rights" Commission Kommissars even less.
If we can't get the judicial review before the Federal Court in time, Ernst Zundel will be sentenced, financially ruined and deported right into a jail cell in Germany for questioning the "Holocaust" - the goal of the Holocaust Promotion Lobby for almost twenty years!
What does this mean? The ruination of one man. A pyrrhic victory for this man's opposition!
Let me assure both friend and foe that the Zundelsite will still continue as your Revisionist flagship - AND NOT ONE COMMA WILL BE CHANGED! The Zundelsite is going to go on. For I am an American, ***not*** under Canada's control. I run the site. I code and post material. I choose what gets sent via ZGrams. My supporters will assure its financial survival! Ernst Zundel is not necessary for all that - and the CHRT Kommissars know it all too well - they know it in their bones! Why else would they not let me say right at the start when these disgusting hearings started when I was right there, in the courtroom, that it is ***I*** who runs the Zundelsite?
NYT: The Canadian Human Rights Commission contends that Zundel controls the Web site and therefore can be prosecuted under Canada's hate laws. Canadian authorities are seeking to apply Section 13 of the Canadian Human Rights Act, which prohibits anyone from using telephone lines to spread hate messages based on race, religion or ethnic origin.
Ingrid: If truth hurts liars - is that "hate"? I don't post "hate" material. My posts are truth material, as best as I can tell. That statute says that anybody who causes hurtful material to be communicated is guilty! But one more time, and for the record: Section 13 of the Human Rights Act applies to ***telephone answering machines*** with information hotlines - ***not*** the revolutionary medium called the Internet.
Last Blast: Do I "cause" the ever-so-politically-incorrect communication to take place? No. Technically I don't. Zundelsite readers do! The legal and technical facts are that ***the person who logs in and chooses to call up*** whatever I post on the Zundelsite - information that is legal and constitutionally protected, stored on a server in California - ***causes the communication to take place.***
Nobody who refrains from logging on to the Zundelsite by his own action is going to be offended and have his feelings hurt. That computer screen will simply stay blank! If one wants to go nitty-gritty, it is quite logical to argue that the visitor, in fact, ***offends*** against the "hate laws" in Canada by logging on - provided that "hate" can be found.
(The Mayor of Toronto, one of the complainants against Ernst Zundel. couldn't find "hate" on the Zundelsite, not for the life of her, though the was given ample time during her cross-examination . . . but she insisted it was there! Somewhere! She saw it! Definitely! She was sure of it!)
As these Inquisition cases go, these technical and legal points have been practically lost - and one more time we are appealing to the technologically sophisticated cybernetters (please, with respectable credentials acceptable to tribunals and courts !) to come to our aid and tell these Torquemadas a thing or two - to wit, that it won't do to shame this century with such a transparent political charge.
NYT: Ed Morgan, national legal counsel for the Canadian Jewish Congress, said it would be almost impossible to bring a suit in the United States to shut down the Zundelsite because of First Amendment protections of free speech that have already been extended to the Internet in previous cases. Ms. Rimland concedes that she frequently uses Zundel as a consultant but insists she is in charge of the site.
Ingrid: That's right. That is exactly right. They can hound and ruin Ernst Zundel - in the process, what will happen? They'll export their censorship attempts to the United States. And then we will really "talk Turkey"!
NYT: Canadian authorities have tried to prosecute Zundel before. In the 1980s, he was brought to trial twice, under the weaker anti-hate laws in effect then. His first conviction was overturned on a technicality, but he was retried and convicted in 1988 under a law prohibiting the spreading of false news. That decision was overturned when the Supreme Court of Canada declared the law unconstitutional in 1992.
Ingrid: This is old hat and talked to death for Zundel-Watchers - but for the many newcomers alerted for the first time by the New York Times article, I'll give the briefest explanation one more time:
The first conviction of 1985 was overturned because the judge refused the introduction of important defense evidence and testimony and made gross errors in law. The Ontario Court of Appeal ruled that Ernst Zundel was not given a fair trial. So tried he was tried again - and convicted again in 1988! He lost his appeal in the lower court but won finally in the Supreme Court of Canada on August 27, 1992.
In other words, Ernst Zündel was hounded mercilessly by Canadian authorities at the behest of the same complainants and intervenors ***with an unconstitutional law*** for almost a decade! With the help of tens of thousands of supporters, who learned about the Zundel story in the media, Ernst Zundel raised and spent millions defending himself - and, by default, what happened?
He exposed the so-called "Holocaust" to public scrutiny! Like no one on earth had ever done before!
His enemies have never forgiven him for that!
He was never given one cent in compensation by the Canadian state. He never received an apology for being unjustly prosecuted, jailed and humiliated. His tormentors walked away scot free - and came back to use the CHRC as their all-too-willing tool. Once more!
Now you can find them, grinning, in the Canadian Human Rights Tribunal room as judgmental accusers and intervenors. For years, they have continued their attacks, unhindered. For almost two decades, they have continued their harassment, unabated. Will they succeed with their agenda this time? Will the CHRT spit-lick the boots of Holocaust Promotion Lobbyists and stoop to genuflect?
You bet they will. There is not even a pretense of fairness.
This Tribunal shows all the earmarks of being perfectly willing to do what regular courts have never permitted - the gagging of a man for speaking out courageously and firmly in defense of his maligned and vilified ethnic group and in defense of his defenseless country of birth, governed by an oligarchy imposed on it by Allied conquerors since 1945 that punishes the questioning of German history by Germans with punishment of up to 5 years in prison!
Ernst says his conviction is a foregone conclusion - because the Canada to which he immigrated as a 19-year-old boy, his heart filled to the brim with a hunger for freedom and justice, is now no longer free. He says that, sadly, Canada is now infested with a parasitic oligarchy that needs those "Zundel punching bags" who can be hurt and vilified with raw impunity. These Human Rights Commissions need to ***justify*** their rape of freedom while whining and complaining about "hate", so as to keep on feeding at the public trough with chutzpah.
