Good Morning from the Zundelsite:



 

Well, have I got news for you!

 

It speaks to the pimping nature of our so-called "mainstream media" that not a word of this has yet leaked out, to our knowledge - but just about a week ago a lady judge with a clear mind and a sound sense of justice has called a predatory, parasitic industry, misnamed the "CanadianHuman Rights Commission" bluff!

 

The case does not involve Ernst Zundel and the beleaguered Zundelsite, but many facets of this case run parallel to the objections raised by our splendid Zundel Team: that toadies being paid by government in certain ways cannot claim independence in their judgment.

 

In legalese, there is "a clear apprehension of bias".

 

Was it not Joseph Stalin who said: "When I say dance, a wise man does"? Somebody pulled the strings - you saw these people dance like jumping jacks! In the Zundelsite case, there was not even a pretense of fairness.

 

The Zundel legal team raised "apprehension of bias" when our attorneys asked why it was just assumed by the Tribunal there was authority to judge a website that was not in their jurisdiction?

 

And why, in Heaven's name, could they ignore such documents as duly registered copyright?

 

Why should it be okay to load one side with intervenors - and dismiss intervenors of the other side by simple sleight-of-hand?

 

And why dared the Tribunal refuse to hear the very person who runs the Zundelsite - on grounds the opposition was not given notice! - yet watch the opposition sashay in a "secret witness" in an audacious power show?

 

Clearly, they were pleasing someone - and that someone equally as clearly did not seem to be Ernst Zundel!

 

These brown-nosed folks have left a record of procedural abuses that generations of legal minds will study as they dissect abuse of power at the behest of special interest groups!

 

And now, it appears, the circus might be over - at least for the time being!

 

A more detailed excerpt of the legal cases that have brought this Marxist industry to the proverbial screeching halt will soon be found on your beloved Zundelsite. For now, a few choice paragraphs have meaning.

 

I quote the most important ones, subtitled "The Consequence of a Finding of Bias" and "Decision":

 

"Everyone appearing before administrative boards is entitled to be treated fairly. It is an independent and unqualified right. . . (I)t is impossible to have a fair hearing or to have procedural fairness if a reasonable apprehension of bias has been established. If there has been a denial of a right to a fair hearing, it cannot be cured by the tribunal's subsequent decision. A decision of a tribunal which denied the parties a fair hearing cannot be simply voidable and rendered valid as a result of the subsequent decision of the tribunal. Procedural fairness is an essential aspect of any hearings before a tribunal. The damage created by apprehension of bias cannot be remedied. The hearing, and any subsequent order resulting from it, is void.

 

(...)

 

The application for judicial review is allowed in file T-1257-97. The proceedings before the Tribunal are quashed. There shall be no further proceedings in this matter, until the problems identified in these Reasons for Order. . . are corrected by legislative amendments to the Act."

 

So there.

 

According to legal counsel, it is now impossible, in view of this exquisite, stunning legal victory for Bell Canada, for the Soviet style Tribunal to keep preening themselves to their clique and to keep feeding off the public trough at their Zundel hate fest.

 

Below is a press release that has gone out to hundreds of media outlets:

 

German human rights activist, Ernst Zundel, will be bringing a motion before the Federal Court of Canada, Trial Division, on Monday, April 6, 1998, at 330 University Avenue, Toronto, Ontario, at 10:00 AM for an order staying all further proceedings before the Human Rights Tribunal which is presently hearing two complaints filed by the Toronto Mayor's Committee on Community and Race Relations and Sabina Citron. The complaints alleged that Mr. Zundel was inciting hatred against Jews on the "Zundelsite" Internet World Wide Website located in the United States and owned and operated by Dr. Ingrid Rimland.

 

The Federal Court of Canada held on March 23, 1998 in the case of Bell Canada v. Canadian Telephone Employees Assn., {1998} F.C.J.313 that the Human Rights Tribunal is not independent of the government and that there is a reasonable apprehension of bias based on institutional factors such as inadequate security of tenure and the method by which the members of the Tribunal are paid.

 

The Federal Court held that all hearings and decisions of the Human Rights Tribunal are void as a result of the fact it is not a body that is independent and institutionally capable of providing a fair hearing in accordance with the rules of natural justice.

 

Ernst Zündel says, "It seems that finally this human rights craze has run its course and the human rights tribunals, which are the enforcers of the ruling oligarchy's will against unpopular ideas and dissidents, are finally being called to the bars of justice and have been found wanting."

 

Madam Justice McGillis is to be commended for her courage and independence of mind in this landmark case.

One final word:

 

I cannot help but think that our website blasts have helped. We called this so-called "Human Rights" Commission exactly what it was - brown-nosers feeding at the public trough. We did so again and again. Somebody must have listened.

 

There are now scores of media folks and legal students who check at websites such as the Zundelsite for indications as to which way the wind is blowing - knowing full well they can't depend on the kept media prostitutes to give them the straight facts. My ZGrams stated, time and again, that toadies munching handouts from the government would get it on the snout one of these merry days for their disgraceful groveling. You did not hear that from your pimping mainstream media sources - you heard it from your dissidents.

 

Exactly as Ernst said: "With gritted teeth, some things will be revealed. I'm now reborn. I'm ready to rip the faces off the hypocrites!"

 

We'll see what happens now to the Zundel case. We should know soon. Today at 3 p.m. the Zundel legal team filed four important motions in the Federal Court of Canada involving the Human Wrongs Commission.

 

In a conversation some weeks ago with one of the Zundel-Haus legal advisors, I heard it said, here paraphrased: "The old Anglo-Saxon legal bulwark is still holding. There is still some justice to be found in real courts in many places while there are still some Anglo judges on the bench."

 

And so it seems. A real judge in a real court has finally spoken. The McGillis Decision has the sheen and the fire of sapphire.
