"A human rights hearing will continue Oct. 14, despite legal attempts to derail it by Holocaust denier Ernst Zundel.
Zundel's legal challenges to the jurisdiction of a Canadian Human Rights Commission tribunal were turned down last week by a three-person panel, which ruled that the tribunal was the appropriate forum to determine whether material posted on the Internet could be regulated. . . .
Last week, Zundel's lawyer, Doug Christie, argued the Internet was not a telephonic communication and so, did not come under the Canadian Human Rights Act. He also contended that the complaint against Zundel was vexatious and made in bad faith and that the real creator of the Internet Web site, called "Zundelsite," was a woman named Ingrid Rimland, based in Carlsbad, California. . . .
The tribunal also reserved a decision whether to permit three Jewish organizations to participate as intervenors in the hearing. B'nai Brith's League for Human Rights, the Simon Wiesenthal Centre and the CHRA are all seeking to participate in the hearing, arguing they have a special interest and unique expertise to offer the tribunal. . .
Christie opposed the application and unleashed a verbal barrage on the three Jewish organizations. B'nai Brith came in for a scathing attack as Christie argued the organization had made common cause with Anti-Racist-Action (ARA) and so, in effect, condoned statements shouted at ARA rallies to burn and kill Zundel . . .
Sol Littman, Canadian Representative of the Simon Wiesenthal Centre, said the centre is attempting to intervene because "Zundel's use of the Internet is a concern for any human rights agenda."
He suggested the case will set a precedent in connection with the application of human rights legislation to the information highway.
Eddie Taylor, legal council for the commission, said "this is the first case regarding the Internet. We're confident that section 13(1) of the Canadian Human Rights Act is broad enough to cover the Internet as a telephonic transmission. . . "
Internet Freedom Fighters, take heed! In effect, this means that, courtesy
of the Holocaust Promotion Lobby, Canada is trying to EXPORT its censorship
laws to the rest of the world, starting with none other than its American
neighbor to the south - while people keep on snoozing because they think
what happens to the embattled Zundel-Haus will not affect their world!
I, for one, think that the outcome is already a foregone conclusion, and
a "cease and desist" order is likely to be imposed on Ernst's
work as a first step - which has been the expressed goal of one of the would-be
intervenors all along. Not that it makes a difference. Canada cannot export
its censorship laws and apply them to the perfectly legal, constitutionally
protected work, writings and actions of a United States citizen who lives
and operates in the USA !
It is also quite possible that a crippling fine will be imposed on the Zündel
operation - regulations allowing the Human Rights Commissions to do just
that was the goal of the re-elected Liberal government already in the last
parliamentary session. Precisely that is part and parcel of the opposition
strategy - to drain the Zundel-Haus of its resources while they keep feeding
at the public trough through government grants etc.
According to some articles that should give food for thought to anyone,
there are no limits set in the amount that can be fixed to punish "hate
crimes" perpetrators. Moreover - and this should frighten you - when
it comes to "Tribunal" sentences, there is no direct mechanism
for appeal. There is no "Federal Human Rights Appeal Tribunal."
A victim of this body lives with the social stigma of being a "human
rights abuser" for years - maybe forever - if he does not have the
money to cure its sting. What they say, goes! No ifs and buts!
Let's say YOU are the victim of the charge of "defamation." If
you want a fair shake, you have to go the parallel route and maybe fight
the "Tribunal" and the Human Rights Commission itself in a judicial
review action in Federal Court. This will DOUBLE the costs for the victim
of a Human Rights Tribunal - because he has to pay for his own defense and
legal expenses, while the accusers, once again, get the government to underwrite
the quasi "persecution through prosecution" of their political
opponents - hardly a level playing field in the marketplace of ideas.
Please realize also that even if your case is won today, some "victim"
of a "hate crime" can come sashaying in to the ever-eager and
ready Human Rights Kommissars' squads tomorrow and start the charade all
over again - all in the name of "Human Rights"!
What do we have here, then?
We have a "governmental hit squad" that you have financed with
your taxes, which does the bidding of special interest groups parading in
their "Human Rights" dress.
One danger to the Human Rights industry in charging Ernst Zundel - and this
will become evident as time goes on and these cases receive a good public
airing - these "hit squads" have now put THEMSELVES on trial as
tools of Soviet-style suppression. They will be so identified in regular
courts, if Ernst's legal strategy succeeds.
This strategy is going to include the Supreme Court of Canada - which still,
so pious people hope, retains a modicum of freedom of decision-making and
is responsive to the will and aspirations of freedom-loving people.
Somebody HAS to stop the abuse of these so-called "Human Rights"
organizations - the very organizations which were, ostensibly, set up to
protect ethnic minorities, including the German ethnic group. Ernst Zundel
is going to do it - as long as the financial support lasts to pay the legal
bills and all the peripheral costs.
Why? Now I will tell you why.
He told me during my recent visit to Toronto where I had traveled to give
testimony. He said to me the day before the hearing:
"I don't want to stand before my Maker when my time comes, having to admit that I did not resist. To the best of my ability. With all the means and funds available to me."
He said that, leaning against his car in the filthy, crime-infested streets
of downtown Toronto - where, once upon a not-too-distant time the Canadian
government was there for good and decent people of European ancestry, and
where, these merry days, the punks, whores, transvestites and drug lords
have taken over to do their slimy business.
The fight is going to go on.
In the interest of saving time and energy, I am excerpting here parts of
Ernst's latest Power letter, because I want to tell you just as much as
possible about Ernst Zundel the man - not "Ernst Zundel the Nazi",
maligned and vilified, whom people have been taught to hate by an obliging
lapdog media. By the time I am through with my part, the world is going
to respect this man, on whom you can bet your last dime.
Ernst speaking here in Power Letter, May 1997:
"In the court room, the atmosphere was Kafkaesque. I had painstakingly prepared lengthy and detailed affidavits and submissions, outlining the relentless persecution I had been subjected to by B'nai Brith, the Canadian Holocaust Remembrance Association, the Mayor's Committee on Race Relations. Doug Christie made additional verbal submissions about the Simon Wiesenthal Centre. These affidavits put on public record for the first time the frequently almost criminal behavior and activities of some of the people associated with these groups.
As always, Doug Christie excelled and was fearless in his presentation of the unsavory facts and details - facts and details which at times even seemed to shake the stony-faced members of the Tribunal. Occasionally, you could see their facial muscles move.
Christie concluded in each case that these potential "intervenors" brought no special expertise to the charges against me and my views into these proceedings - only fanatical animosity, even hatred. He was brilliant, incisive, full of fervor. He fought bravely against overwhelming odds.
It was as though he spoke to iron and to stone. It seemed clear to observers that the outcome was already a foregone conclusion. Furthermore, it seemed obvious that the Tribunal members could not possibly have read the material submitted by me - for even the Chairman of the Tribunal at times was at a total loss, thinking that the affidavits (which clearly are headed on the top of the document with 'Canadian Human Rights Commission') were, in fact, for the Federal Court. Christie had to clarify that simple but important detail for them.
In future newsletters, when the transcripts for these proceedings have been prepared and purchased, we will bring you more details. They are important parts of history as we are reclaiming our heritage.
The surprise of these proceedings was that, for the first time ever, endorsements of my work against relentless anti-German hate propaganda came from German Canadian Associations and spokespersons. It had been hard in the past to engage them, since all of them are afraid of the powerful and terroristic Holocaust Lobbies who can snuff out jobs and get people fired - as we have seen in the cases of the Canadian school teachers Tim Keegstra, Malcolm Ross, and Paul Fromm.
This ethnic contribution to my mission by other German people, comprising over 10% of Canada's population, was greeted with snickers and deprecating comments by the Canadian Human Rights Commission lawyers, which will haunt these government flunkies for a long time to come. They sat there, appearing jaded by not only their looks and attire, but also by their comments and demeanor, as though they owned the world.
These people could not recognize a genuine human rights abuse case if it bit them in the ass!"
